There was an injustice alright 517 of them not to mention stagnating my career for yours. My upgrade moves from 3yrs away now to about 7yrs. Yeah I got phuked saving you, that's how the vast majority feel round here.

Really? How old are you? If you are under 40, heck even 45 you will be going MACH 1 through the equipment from the left seat, including trans-oceanic thanks to east retirements.

If that is your idea of getting screwed, I want to be in your shoes.

Yes, we did indeed sign on to binding arbitration. But that arbitration was supposed to be grounded in ALPA policy which demands "no windfall of one group at the expense of the other."

The arbitrator ignored ALPA policy in this regard. Plain and simple, the arbitrator did not do the job he was hired to do under ALPA policy.

The arbitrator, though given wide latitude in his reasoning, is not given a blank slate; he must follow policy. Nicolau was given a task suited to King Solomon and filled it like King Kong.

In the Award Nicolau he cites the appropriate ALPA Policy and his belief that he fulfilled it. As it so happens, he's the final arbiter. You're entitled to your opinion but just like mine it's meaningless.

I'm 41 and having seen the actual list and I won't see an upgrade for atleast 7 more years. Now if we had not gotton into this transaction I would be up in 3 years so in essence I have lost several years as a result of this deal. BTW I am not talking about the new Large RJ's we have either!!!

The list was based on a zero growth scenario. AWA list, zero growth and you check out in 3yrs, new list zero growth and you check out in 7yrs.

Feed in the east and eventual west intl. growth and massive east retirements and you still will check out in three years, but you will probably have to go to New York to get a bid.

Ok tell you what bro, If I am up in three and I am willing to bet I'm not based on what I've seen thus far then I will admit I'm wrong. Now I'm not speaking about the E190's nor am I talking about commuting clear across east hell to sit super JR res in someone's crashpad... I am every bit of 3 or 4 yrs away just on the AWA list alone!

You are making a BIG assumption that you would have a seat to upgrade to. Your company was not zero growth, it was retracting.

I find it so hypocritical to say ALPA merger policy wasn't followed when your merger committee's ONLY stance was DOH which was specifically removed from that same policy years ago. Exactly what constitutes a "windfall" is way to subjective to have any teeth in legal proceedings.
