AAA ALPA Thread 9-21 to 9-27

I guess we'll see when a joint contract goes out for membership ratification with significant pay and work rule improvements for everyone overnight. IMO that resolve you speak of will dissolve. If it doesn't pass you can call me wrong. In fact I'll be the first to admit it.

Now, why would anybody vote to give their seniority away? Call me old-fashioned, but isn't that the only reason one stays at the same airline rather than jumping around from carrier to carrier? And, didn't good old ALPO start out with the seniority concept in mind? Do the leaders of ALPO have a Roberto Gonzales complex -- can they not recall anything?

All the more reason to boot the ______ (oh fill in the blank because if I do Richard will kick me off)

Today’s action should remove any doubt from the USAPA fence sitters that ALPA will not do anything regarding the Nicolau Award

767jetz said: But I thought there were no "fence sitters." I thought there were already enough cards.

USA320Pilot comments: As I have said before you are apparently ignoring, nobody knows how the NMB will rule on every card and USAPA wants a margin of error. That is not different than a pilot wanting some extra fuel.

767jetz said: The EC will put the JNC on the fast track, and if the East stalls, then the EC will sit in place of the East at the negotiating table. They have committed to defending the award, and this would include attempts to delay it's implementation.

USA320Pilot comments: The EC wants to peddle faster because they’re scared of USAPA. But, if the US Airways JNC members are at the table the EC will not intervene. Furthermore, nobody can force the US Airways pilots to agree to a TA or to ratify an agreement.

USA320Pilot said: “Furthermore, today’s action will likely strengthen USAPA, it will undoubtedly accelerate “kicking†ALPA off of the East and West property.â€

767jetz said: “I disagree again. Now that the award will be submitted and defended, it makes it even more of a certainty that any successor union will be bound by the award. This will make it even more likely that the majority of East pilots will realize the situation, and decide that their best hope for significant quality of life improvements will be to vote on a joint contract that will increase their pay and benefit their families in the shortest amount of time.â€

USA320Pilot comments: Obviously you do not understand the resolve of the majority of the East pilots and the East MEC. The majority East pilots prefer to live under LOA 93 and realize their significant attrition based career expectation. Next year US Airways will add 490 pilots to the payroll, with virtually all of them on the East. This permits reserves to become lineholders, First Officers to become Captains, and narrowbody pilots widebody pilots.

For example, under the new joint contract a narrowbody co-pilot will probably see a $15 per hour raise; however, if that pilot upgrades he will see a $40 per hour pay raise.

USA320Pilot comments: If there was ever a chance for a negotiated settlement it is now because the choice for the AWA pilots is simple: Cut a deal or have union “impositionâ€.

767jetz said: “Haven't you figured out yet that the West is not interested in giving in to threats and extortion? They haven't seen this through all the way to the end, just to throw in the towel and submit to the will of the East. The only deal cut will be at the JNC table. This will be over, and a tentative contract will go out for a vote before the USAPA can even finish counting their cards.

USA320pilot comments: At this point most of the US Airways pilots could care less if there is a deal with the West pilots. Why? Over 2,400 East pilots have signed USAPA cards and they want a new union and a new merger policy. I find it interesting that you as a reserve UAL pilot have so much interest in US Airways and seem to know so much but yet no so little. You have no idea what is going on in the minds of the East pilots and there will be no joint contract that contains the Nicolau Award.

There will be a new union election, USAPA will likely win, and then the fun will begin!

Regards,

USA320Pilot

The US Airways pilots have all the leverage on whether or not the Nicolau Award will be implemented and that is with their joint contract vote.

ALPA wants to peddle fast becuase of their USAPA fear.

Hey USA320pilot,
11 million union clams is a lot for ALP0 to lose. Do you think Prater will have to cut his $450,000 union salary, will the MEC keep their ALP0 pensions, and heck will ALP0 be able to keep paying their secretaries $90,000 a year?

I never said that anyone would force pilots to agree to anything. I do think that once a joint tentative is put out for membership ratification, the resolve you talk about will dissolve. I think that there will be a contract on the table with significant pay and work rule improvements above the $15 raise you talk about. And that contract will allow everyone to enjoy a better quality of life overnight, guaranteed... rather than waiting for some future upgrade that may or may not happen. But as I've said before, once the pilots have something to vote on, we will see who is actually right. I must say that your predictions and statements since the Nicolau award was rendered has been off the mark quite far.

As for the USAPA, again we will see. But I think most are not falling for the threats. No one is scared. In fact I think most just want the East to get on with it already. Have your election and see where the cards fall. I think most reasonable people know that the path the East wants to take to avoid the Nicolau award at all cost, is so full of potential disasters, that one way or another the award will stand. And then the East will be even worse off, having thrown away an opportunity to significantly improve their quality of life. You see, the real risk lies with the East. They are the ones rolling the dice with what's left of their careers. I know you disagree, but that is my opinion.

It's like retirement investment strategies. When you're young you can weather the ups and downs of the market. But as you approach retirement, the wise investor moves his assets to less risky funds. As you age, your risk tolerance decreases. That is where the East is with their career. If a USAPA issue even comes up for a vote, many pilots will be doing a serious gut check to assess their risk tolerance so late in their careers. This is where the West's youth is an advantage. You say, "game on!" well get on with it already. In the mean time, it's OK to admit that you are wrong once in a while. In fact it's healthy.

peace,
767jetz

You don't know about the donations.

USAPA is bulding a war chest. We have lots of money, but we want more in the war chest.

We are getting donations from all aspects, senior to junior, east and west, other airlines and non airline contributors who wish us success.

Lots of big donations and lots of support from the senior guys, one handed me a check 2 days ago, thanks!

Get ready for an election, we are days away from having enough cards. The EC resolutions will put USAPA over the top, and the donations will start rolling in now.

Bus driver

I saw this on aother thread. It supposedly comes from your USAPA website... Is it true? Care to change your statement...?

"Of the 2300+ pilots who have sent in a card, only about 300 of you have stepped-up to the plate and sent a donation. You/we need additional funds to get us from where we are today to the finding of a representational dispute and on to the election itself. While we and our advisors believe strongly that the NMB will deliver a finding in our favor, the process necessarily chews up quite a few lawyer and consultant hours.

Based upon our projected needs, we need every pilot to contribute at least $200 and to do so soon. If you can only manage $50 off of a credit card, please do so - hopefully a fellow pilot can make up the difference. If you had a marvelous time on your last Vegas layover, send along a generous portion of the spoils. We have a narrow window of time for the filing. Let us be as clear about this as we can: we do not have sufficient funds to complete this journey."

All I can say is wow! This seems like a much different picture than the one the USAPA supporters are painting...

Why today's ALPA EC news is not so bad

I was initially disappointed in today’s EC actions, but the more I think about it the more I am encouraged. Why?

July 2001

"Today's news that United Airlines has officially terminated merger talks with US Airways was fully expected, and is actually good news for the merger. Here's why...."

It's true. Filling out a card is easy, especially when the bulldogs are breathing down your neck. But writing the check is a different story. I think someone posted after todays ruling, they expect another 200 cards to be filled out. OOOPs, even with 200, still gonna be short!

Silence from the camp?

An email from a pilot to John Prater,

Captain Prater,

You and the EC have sealed the fate of ALPA. Your actions or lack there of have only enforced the fact that ALPA National is nothing more than a political hole to pour our dues into and receive virtually nothing in return.

I predict that you and yours have set the stage for the demise of ALPA as we know it. I have been losing faith for years, what with the lack of support in areas such as drug test, alcohol test, subjecting pilots to routine security as if they were criminals, allowing our pensions to be robbed by management, and now the final slap in the face. Other than safety, I see absolutely nothing
that ALPA has done for our pilot group or industry. You and the EC have now given all the credibility to the movements at Northwest and United to leave ALPA that was needed. I predict that now ALPA will never sign another carrier and the likelihood of signing anyone such as JetBlue, Airtran, Virgin, etc, etc, will never take place.

You and yours will go down in the history books as the leaders that ended the long history of ALPA, a once proud union. The true sadness is that there were very few pilots on our property that believed ALPA would truly step up to the plate and do anything. This time however, the lack of action will be far reaching.

US Airways ALPA MEC CODE-A-PHONE UPDATE #2b - September 20, 2007

This is Richard Obermeyer with a second US Airways MEC update for Thursday, September 20th, with three new items.

Item 1. US Airways management has noted a steep climb in sick calls which they believe may be an illegal sickout. Neither ALPA nor the US Airways MEC supports, condones or is participating in a sick out or other job action. Such actions may be unlawful and may expose you to discipline up to and including termination.

Do not participate in any sick out or other job action. Follow normal procedures in all respects and do not follow suggestions to protest terms or conditions of employment through sick outs or other job actions.

Item 2. The Executive Council today passed four resolutions that address issues raised in the ongoing merger of US Airways and America West.

The Council found that there was no basis to set aside the seniority arbitration award issued in May by an arbitration board. The Council concluded that no evidence of impropriety or failure to follow ALPA Merger Policy had been presented. ALPA will now defend the award. The award is to be submitted to management as issued, but with the proviso that it will have no effect until the parties complete a single collective bargaining agreement.

The Council determined that there was no basis under the ALPA–US Airways Transition Agreement to contest the operation of US Airways under a single FAA operating certificate with separate operations that keep the aircraft and pilots of AAA and AWA apart until completion of a single collective bargaining agreement.

The Council is supporting a fast-track negotiating strategy to raise the pay of AAA pilots in order to achieve pay parity with AWA pilots and to achieve major raises (pay parity plus) for both pilot groups. These negotiations—which will move AAA and AWA pay rates beyond current AWA levels—will be conducted by the JNC.

Access to the $2 million previously approved from the Major Contingency Fund to support AAA and AWA pilot groups for strike preparedness, communications, and family awareness activities directly attributable to joint negotiations will be allowed once the AAA MEC resumes their participation in joint negotiations and submits a communications plan and budget.

The resolutions have been sent to all US Airways and America West pilots in an ALPA communication.

Your MEC and MEC officers are obviously very disappointed in the Executive Council’s actions, particularly in their decision to have ALPA defend and submit the Nicolau award to management. We expect US Airways management to review the seniority list according to the thresholds of the Transition Agreement. If you review these thresholds, management’s decision on how to treat the award becomes somewhat apparent. However, keep in mind that the seniority list will not be implemented until a single joint contract is reached, which requires ratification from both the AAA and AWA pilot groups.

Additionally, the work of the Rice Committee and the MEC’s decision to address the injustice of the award through litigation continue.

Your MEC will be discussing the EC’s actions tomorrow during a special MEC conference call meeting.

Item 3. Captain Lyle Hogg, Director of Flight Operations, sent out a CBS message to all pilots today that said the company is starting to experience an abnormally high number of sick calls for both September 20th and 21st. He asks that medical documentation be provided to your Chief Pilot for all sick calls effective immediately through tomorrow, September 21st.

Posted on the pilots only website is language that is taken from the “sick notes†grievance settlement document. According to the Sick Notes grievance settlement document, if a pilot is required by the Company to provide proof of illness or physical disability pursuant to Section 14(G) of the Pilot Working Agreement, the pilot will do so in accordance with the certain protocols. These include:

· How and from whom to obtain the requested sick note

· What information the sick note will contain

· How pilots will be compensated for reasonable costs incurred for ground transportation to and from the health care provider

W.A.R. Item 917

FOM - Warning: Do not attempt to land from an unstabilized approach. The decision to go around is not an indication of poor performance, but rather good judgment.
Educate to Vacate

Below is a link to a video recording of a PHX pilot meeting with Parker on February 6, 2007 . This video is posted on both the AWA and AAA Pilot’s company web sites as is all the other meetings that Parker held with employees. Parker's consistent message which has never changed, was that AWA would be in bankruptcy and would have down sized and taken pay cuts absent the merger with US Airways and that the merger was mutually beneficial for both companies.

Equal pay for Equal Work:

It has been 20 days since September 1, 2007 , the start of retro active pay.

Money to be paid to each Group 2 Captain is $1068

Money to be paid to each Group 2 First Officer is $524

Pilots on all other aircraft will receive the same percentage increase as Group 2 Pilots (approximately 15%).

Follow the three-prong approach, fly safe and thanks for listening.

Another East Email posted with the Author's permission

Like most of you last night I was in a bit of shock watching the company’s response to a perceived job action and the EC’s actions.

After thinking about the events I now realize those actions are “not so bad”, they will speed up the process, and bring resolution to the Nicolau Award battle one way or another.

Why? I believe ALPA has washed their hands of the situation and they are concerned about one thing â€" the “mother ship”. ALPA recognizes the only way to get pay raises for the rest of the industry is to get the Nicolau Award problem set aside and a new joint contract or no other pilot group will see economic gains. The pressure on ALPA to get ride of the Nicolau Award problem is growing and if ALPA did not act now they knew there would be a representational election.

Therefore, where do we go from here?

- Step 1: Go to work today, which will help prevent any problem with the company.
- Step 2: Everybody must SAP down to the SAP floor in November and realize you can still and must obtain full pay. This is a legal tactic.

I will say that the hard work has yet to come. I fully expect to be in a representation election in a matter of days. And we will need all US Airways pilots - east and west - to pull together else we may not make it over the next set of hurdles.

There is a very long road ahead and it will require a lot of dedication and effort to navigate this road.

Thank you for your cooperation with my request.

Per the Transition Agreement the company still cannot implement the Nicolau Award and we have the leverage, but now we must act.

3. The MEC must authorize the Negotiating Committee to re-enter JNC talks to prevent ALPA from negotiating for us. The East JNC members must drag out JNC talks indefinitely. Why?

From today’s AP article, “You have to understand how important that is to a pilot, Stephen Bradford said. “In many other job classifications, the seniority issue boils down to who gets vacations. In the case of an airline pilot, you're talking about opportunities (to be promoted) from co-pilot to captain. “We're talking hundreds of thousands of dollars per year'' in salariers, he said. “It's a huge impact.''

4. Send in your USAPA Authorization Card today. No more “Fence Sitting”. ALPA has shown that their interest is in the “mother ship” and they are willing to sacrifice your seniority, if necessary, to meet their objectives.

To obtain a card click here.

USAPA is close to forcing a representational election, but they need cards today from the “fence sitters” to insure a victory.

See Story:

5. Please send USAPA a financial donation. The “Fight is On’ and now USAPA needs your contribution more than ever to build the “war chest”. Legal representation to win the election, prevent the Nicolau Award from being implemented, and starting a new union will not be cheap. This is not a long-term process because once USAPA becomes the new bargaining agent both the East and West pilots will be required to pay USAPA union dues or go into bad standing and not be able to vote.

Please send a donation today to:

The US Airways pilots can and will win this election, but it is going to take every one of us to act as a team. It is clear the John McIlvenna is “freakin out” and now the US Airways pilot options are clear and concise, which I have listed above.
