  • What list has the federal courts said should be the list, baring a DFR?                                 The Nicolau List
  • What list did the AASPIC argue as the starting point for LUS?                                               The Nicolau List
It sound to me like the Nicolau List is ALIVE AND WELL for the time being.
 
BTW....we say THANKS to Marty & his team EVERY SINGLE TIME WE SEE THEM.  What do you say to your lawyers?

Really? They "win" but are told to keep their monthly donations going? Really?
 
  • What exactly are we to "negotiate"?  If you are referring to the Nicolau Seniority List, that is the PRODUCT of a MUTUALLY AGREED UPON PROCESS.  Under what authority does one party negotiate AWAY from the PRODUCT of a MUTUALLY AGREED UPON PROCESS just because the other party says "IT'S NOT FAIR"?  Is there a "fairness" measure/ barometer that somehow magically rings a bell when you believe you've not been mystically cheated?
  • Of course we are asking our fine, upstanding group to CONTINUE to contribute.  Freedom isn't FREE, and neither is JUSTICE.  Our STELLAR legal team is worth EVERY SINGLE DIME THAT WE'VE PAID THEM.  I'll bet you can claim the same, right?
  • It's a step in the right direction, but the AWA pilots will NEVER be made whole from the path that you have FORCED us down.  The only winner in that path has been US Airways.  They pocketed every single dollar that you willingly gave up in the attempt to evade your word and responsibility.

How much was AOL asking for in costs? I'm sure it's right there with your other quotes.

Maybe you should read those filings FIRST, and then read the agreement (when it comes out) SECOND so you can understand the dynamics.  Just a thought, before you open your pie hole.

I remembered that AOL asked for more that chilless said. Was I wrong? If so, it's a simple question and you could answer it very quickly. Show me the filing and if I'm wrong, I'll admit it.

Pretty simple to look up, but we'll HELP YOU FIND THE DOCUMENTATION (again - just like we ALWAYS have to).

I do have it right.  I simply READ the various court documents and take bits & pieces IN CONTEXT to school you in what the courts & others "in the know" seem to understand.  Here's another little cherry:

Accordingly, if USAPA wishes to abandon the Nicolau Award and accept the consequences of this course of action, it is free to do so.  By discarding the result of a valid arbitration and negotiating for a different seniority regime, USAPA is running the risk that it will be sued by the disadvantaged pilots when the new collective bargaining agreement is finalized.
