What are you talking about MM?  AOL is taking $5.5 Million and our lawyers are already paid.
 
That is $3600 per West pilot paid from the uscaba treasury.
 
Oh and BTW...the Nicolau list is to this day, still the only accepted system seniority list covering all LCC pilots.

Duh...we made it happen....The West introduced the Nic in current SLI....the nAAtives introduce the Nic in the current SLI...the east...well they got a DFR violation and were just stripped of 73% of the remainder of the uscab treasury...but they did put up a fantasy proposal that violates the law and runs counter to the 9th's ruling in the current SLI.

The most important part of the 9ths ruling, AND that of Judge Silver is that they both flatly REFUSED to impose the NIC and made it clear that the BOA was free to do anything they wished.
Now that being said, anyone that thinks they know how the BOA will decide this is a blind fool. There is a lot of testimony to review and we may ALL be surprised at how it turns out.

Perhaps west pilot spokesman Auxier can explain the absence of the Nicolau Award.

And if you really think about it, that is money that you already paid in to USAPA. Let's see 8 years at 2k per year = 16k. So look at it this way your total costs for no nic is only $12,400 per pilot.

So the west is starting to gloat about winning a sttlement... since there are as yet no real confirmations of the details, my guess is we soon find out it's another west premature elation.

Does anyone find it ironic that AOL was always unable to negotiate.. until they were able to negotiate?

And AOL is STILL advising everyone out west to CONTINUE their automatic push for justice contributions... (Read it for yourself on catpilot.com)

Really? They "win" but are told to keep their monthly donations going? Really?

Actually, if I really think about it, as a West line holding A320 capt for the entire time the scab union was the bargaining agent, what I lost was about $25k-$30k per year in lost wages because of the inability of the scab union to get all LCC pilots a new contract.  So, about $200,000 for me.
 
Now my friends on the east in the exact same situation, (A320 lineholder capt) lost about $50k per year, or about $400,000 for the 8 year failed experiment of forming a scab union.
 
And yes, it is money already paid into uscaba, but it is also money uscaba can no longer spend to the detriment of the West as they have been doing for the last 8 years.
 
Oh, and Marty says thanks to uscaba and the east pilots for paying 2/3rds of his 8 years of employment.

I have no doubt we will all be surprised by the BOA when they issue their award, and yes they are free to do as they wish....um..well...as long as "as they wish" complies with the fair and equitable standard, is free of inappropriate coercion, and remains within a wide range of reasonableness within industry practices.
 
But, if I were on the panel of arbitrators, and I had read the 9th's ruling regarding uscaba's DFR guilt and the dicta stating the east pilots should no longer be the beneficiaries of the scab union's guilt, I would feel compelled to start with the Nic as proposed by the West and AAPSIC.

9 years, and all the east got out of it was $400,000 each in lost wages, 170 days of lost vacation, and a stigma of a scab union.
 
The Nicolau Award survived uscaba, and was introduced in the current SLI, just as predicted by Freund 10 years ago at Wye River.
 
 
So, the question begs....exactly who are the "liars"??
 
The self righteous self congratulation may or may not persuade the BOA. Pat your back harder, the BOA might not see you... And show them your monthly AOL donations (after the global settlement) for extra sympathy!
 
Phoenix, thanks for the advice.  Will consider everything, but judging from how things are going for the west I do not think we have anything to worry about with the SLI.  Which is good, for all of us really, because we can finally all move on... together!  Brothers in arms!  What do you think???
And thank you for the $5.5M, it really makes a difference for us out west because our litigation expenses were about $2.5M total.  Now we have a nice reserve cushion to draw from in case we have to fight any deranged ideas coming from east of the Mississippi again.  You guys sure can come up with some nutty ideas!!!  But all is good now!  Cheers!!!
