The SCOTUS is supposed to enforce the Constitution. If you can show me a specific section in the Constitution that states specifically that marriage is a fundamental right I will never discuss this topic again on this forum.

If you knew anything about the COTUS you would not ask such a ignorant question. The Constitution does not mention anything about the right to drive, own a house, drink, eating or anything else for that matter. What the COTUS does say is that all laws must treat people equally.

As far as fundamental rights go, do a sec for court cases. You should come.up with numerous hits. The courts have viewed marriage as a fundamental right. That goes for both conservative and liberal justices.

There is also a separation of church and state.
 
I have seen several articles of gays suing churches to try to force the church to marry them.
 
There is also the fact that homosexual acts are unnatural as they can never result in procreation.
 
You are trying to legitimize an unnatural act using the power of the courts without the say of the people.
 
That is by definition unconstitutional.

Churches being sued? There is a lady suing to sell the sun. Who cares. There is no law to support a claim against a church. Kennedy even said that in his opinion.
