Ive said I dont know much about court proceedings. I have never been in one. I would have thought that the plaintiffs would have had a witness list in time and if not, werent Hogg and Morrell there? Seems they could have come up with something.
Heres a little more about it:
MR. GRESHAM: We're a little puzzled, seeking
11 guidance about this notion, we thought all of the witnesses
12 would be subject to Direct and Cross. We had let the company
13 know ahead of time that we, you know, we did our witness list
14 and all and this. We're not quite sure what this notion
15 means that.
16 THE COURT: Well, I mean, my guess is that lawyers
17 have strategy and there's some strategy by the plaintiff. I
18 don't know I have to inquire, and they have to disclose.
19 They're trying this case the way they want to try, they're
20 not crossing your witnesses.
21 MR. GRESHAM: But I took the view that they weren't
22 crossing them, that they were saving for rebuttal. These
23 folks are flying. We didn't understand that that meant they
24 were going to have to stay on that -- in other words, they're
25 now released as far as witnesses because the opportunityto

1 cross-examine is here. So I just want to make sure --
2 THE COURT: I don't know what the plaintiff's
3 rebuttal case is. They have the burden in this case. I will
4 let them put on a rebuttal case when that time comes and I
5 guess they will.
6 MR. GRESHAM: I guess I'm trying to understand if
7 they thought they were reserving some examination of those
8 two witnesses in their rebuttal case. Now, obviously I guess
9 they could call them back. But I thought this was the
10 opportunity for them to cross-examine.
11 THE COURT: Yeah. I think they waived their right
12 to cross-examine the witness.
13 MR. GRESHAM: Thank you.
14 THE COURT: But I'm not going to inquire.
15 MR. GRESHAM: That was the only thing that I was
16 puzzled by. I understood they had a chance to put on
17 rebuttal, so that's fine.
Then this:
THE COURT: Any Rebuttal evidence?
2 MR. SIEGEL: No further evidence.
And this:
THE COURT: You can make that point for the record,
22 but in my perspective I think both sides have had a
23 sufficient amount of time to make their case to me.
So Jim, where did I miss the real reason for no cross. Youre not buying the benevolent company line, are you?
