No, read the MOU.(again). USAPA (the merger committee and administration compatible with it I would say), as far as the SLI is concerned, maintains its own existence until the SLI is complete.

Only until the completion of the SLI does the total existence of USAPA disappear. Why don't you call Holmes or Calveri and ask them. They'll tell you that.

The administration is assumed by the APA. That comes from the NAC.
 
I wouldn't be so sure Courtney. The Nicolau is the only list the company currently has and why are they so intent on a decision from a judge as to whether or not they can use it.


Gee, I could have sworn that the last bid used a different list here in PHL and I think the last PHX bid used yet another. Maybe you should tell "Team Tempe" they are not using the "correct" list!

OK, I'll take that because I wasn't more clear. The Nicolau is the only integrated list the company has in its possession.

It comes from the APA and NAC. They were standing together when the question of being separate from the company came up and who would handle the money during SLI. Both the APA and NAC came to a consensus that the APA, post single-carrier, would take on that responsibility. As for where its written, I don't know.
 
So APA argues APA side and APA argues USAPA side. Or better yet, APA tells USAPA what they can argue.

Where did you come up with that? USAPA argues our side and APA argues their side. USAPA does so independent of APA and the company. I thought you understood that.

Again, the list exists. The company doesn't submit it but it doesn't preclude the APA from using it at all.

And no Jamie, you can't fix stupid. Its why we're under LOA 93, an injunction, and a minor player in this merger.

I would accept THAT!

But the money and the argument of integration are completely separate issues, and for the SLI USAPA still exists, the APA would be the keeper of the money, unless you're suggesting that the APA could withhold it unless USAPA agrees with their position.
 
Has anyone noticed that those with the most reasonable questions and concerns with this proposed MOU are among the longest serving pilots around here, who've seen the proverbial movie many times now? Against those; largely nebulous, infantile BS about "moving on" is the bulk of what's offered by those most enthusiastic about accepting the agreement? Just something to consider folks.

No, I'm not suggesting that at all. My interpretation is that APA would act more like an escrow company.
