You guys don't get it. USAPA is free to negotiate, but they do so at the risk of a DFR coming crashing down on them. I think AoL will sue us as soon as we put together a completed list not using the Nicolau.
The APA is also free to put whatever list they want to put together and I think they'll use the Nicolau to avoid litigation if their list is used. I honestly don't think the arbitrators are going to move away from the Nicolau either.
And we don't have a case for a DFR. We can file for one, but I doubt it'll go anywhere. I said this before and I still think telling the judge we're mad because they used an arbitrated award isn't going to go over well. AoL has proven merit and we're about to give them ripeness.

At least you say, "I think" half a dozen times. Yes. We do get it. You apparently don't. Again. Anyone can sue. Anyone. But possession is 9/10ths of the law. AOL will not stop an 8 billion dollar merger from going through. AOL can and will sue. It is expected. Right now USAPA has more than 5 million in the bank. It will be more than 6 million by the time the merger takes place. US/AA had agreed to pay for the Merger and Seniority expenses of both unions. What do you think USAPA plans to do with that money? If you're a West pilot and you want to fight to the death, you better get your checkbook out. You will be fighting from behind the 8 ball.

But it's going to be so easy. Apparently (according to you) USAPA and the APA are terrified of letting an impartial third party make the decision (heaven forbid it should be fair), which by the way would remove the liability.

Let's see, a case that has merit and lacks only ripeness and we will check off that box when we will offer a non-Nic SLI is not going to stop a merger with an injunction? If I were the APA and Parker, would I risk that possibility? No, I wouldn't.
And those AoL guys have been fighting from behind the 8 ball for all these years agains all of our dues and managed to keep out majority in check. I wouldn't put anything past them.

I believe that is correct. Since we have this cloud over our heads (the NIC) the only cover is through the arbitration process using three arbitrators under M/B. Once they reach a decision, I believe a DFR would be a tough egg to crack. Sure, there are those that will try and will spend a huge amount of money, but ultimately, the only winner will be Marty. Just an opinion...

Are you really still trying to pretend you were not a West pilot? AOL has had their ### handed to them in the last two rulings. If you're hanging your hat on that big damages payday, you're gonna be waiting a long long time. (Think forever). How long have the TWA pilots been waiting?

USAPA isn't afraid. But APA sure as hell is. They've seen what a Nicolau type award can do. I can't say anymore without giving up strategy. To quote Finding Bobby Fischer: "you've lost...you just don't know it yet"

The Company already knows what the outcome will be. The company needs cover to say "look! We did everything we could". Sorry guys.

DcPoser is quite amusing. He has stated he is " home grown " more than once when questioned on his original AAA status. Guess his conscience won't let him out right lie which is a good thing. So he sidesteps with the " home grown " .
I have dialoged here & pm and he will not answer a direct question but had the audacity to call me evasive.
I along with all Easties I recall just simply answer a direct question whether it reinforces OR weakens our POV. Hells Bells.....just a stinken completely irrelevant Webb board. These are not top secret / life & death issues.
IMO evasiveness = nearly all westies. Don't believe me , ask a westy his/her AWA month/year doh and listen to the crickets . Even the ones like Bean here avoid, and I think he's somewhat likable / humble / forthcoming . Btw....hope that young one got better :)
