August 2013 Pilot Discussion

Try and side step all you want. The question is, can you not see the irony of the two different agreements and how each party is handling their responsibility? breeze
I don't see how irony applies at all. What responsibilities to the MOU do west pilots have right now, today?

By the way I would have also supported east pilots challenging the NIC award back in 2007 if it was felt that the NIC had violated the TA or ALPA merger policy. If the challenge was won then great for the east and they got the NIC removed or changed or whatever. The west would have had to move on with that result. If they lost then they should have accepted the loss and moved on to getting a new contract. Spending six years avoiding the question and refusing to abide by the terms of the existing contract is out of bounds in my opinion.
Hypocrite. What about the 9TH Circuit Court? The declaratory judgment? You conveniently back what seemingly helped your sorry behind, the nic. You west pilots have spent six years avoiding the question, not the east. Never forget, you were hired at the only airline that would take you, bottom of the barrel america west airlines.

The enforceability of the NIC pursuant to the union's DFR. The Transition Agreement.
"IN THE UNITED STATES DISTRICT COURT
FOR THE DISTRICT OF ARIZONA
US Airways, Inc.,
Plaintiff,
vs.
Don Addington, et al.,
Defendants.
))))))))))
No. CV-10-01570-PHX-ROS
AMENDED JUDGMENT
(to add description of class)
Pursuant to the Court’s resolution of the motions for summary judgment,
IT IS ORDERED Counts I and III of the complaint are dismissed and judgment is
entered in favor of US Airline Pilots Association on Count II of the complaint. US Airline
Pilots Association’s seniority proposal does not breach its duty of fair representation
provided it is supported by a legitimate union purpose. This judgment is binding on the
following class: “All pilots employed by US Airways in September 2008 who were on the
America West seniority list on September 20, 2005.”
DATED this 4th day of December, 2012."

The Ninth and Silver never answered the question. The Ninth said they were jurisdictionally precluded from granting relief to either party. Silver said she wished she could do more but couldn't because the Ninth's decision prevented her from ruling on a matter in a satisfactory manner. The Company says it's not resolved. The NMB says it's not resolved. What more proof do you need?

The Ninth dismissed the DFR, period. Judge Silver issued her order, not in your favor. Anyone can appeal, You west pilots did and so did the company. The NMB is waiting for the company appeal to be dismissed. The company is stalling, period. The company is not the law.

Callaway's judge,

The Rico against the west pilots is where the court said they were jurisdictionally precluded from granting relief to either party.

"While the Court has concluded that such actions do not come
within the purview of RICO, it may well be that a Court of appropriate
jurisdiction will conclude that such actions do constitute violations of state
law and that injunctive relief is warranted to prevent this type of conduct
from continuing. Because the Court has concluded that subject matter
jurisdiction does not lie, however, the Court need not reach the issue of
whether injunctive relief would be appropriate based on the facts presented
in this case."

Callaway version of Judge Silvers order in favor of USAPA in the declaritory judgment.

Sarcasm, ruling as perceived by Callaway;

"I am ruling in favor of USAPA because the Ninth ruled in their favor too. We both had to due to those pesky laws that our founding fathers set up. I wish I could do more but the Ninth Circuit Court would cop me an attitude even though they like the west pilots "more better" like me and.............................//////////////;;;;;;

The West has had to drag your scab asses in front of a Judge every single time. And every single time you waste millions of dues dollars in a desperate attempt to not show up. Why didn't Bradford testify? Why didn't scumanski take the stand under oath? We ALL know why. To avoid the question. Once again, you failed. I Think Silver is going to shove an injunction up your six and USAPA will be dead and buried before the 9th hears the slightest little whimper from you pussy ass scabs.

Maybe Silver will give you the Nic before the Feb bid closes. Just make sure your buddy keeps your keys while you celebrate. We don't want you to hurt anyone. :lol:
