I really find it funny how the west pilots take lawyer filings and say it dumped on this group or that group. Essentially all the filings are, are their argument to try and lead the judge to their idea of how they want things to turn out.

Of course AMR wants it ripe, so they can get the money. BUT big blockage is, what do the courts say on the ripeness test? A BK judge holding a conference with no background on the case and/or decisions handed down, saying on the off hand that well it's been 8 years I could imagine it's ripe, doesn't really make the case ripe. I would imagine if you put the 9th decision in front of him and asked him what his opinion on ripeness was after reading it, it might just change.

I have made my peace with the situation. Looks like next Tuesday the NIC is going to be imposed on our pilot group by Judge Silver, following her declaration of ripeness. Now that we have another airline company commenting on our seniority dispute, there is no way we can prevail. And on top of that, Parker has turned on us, having once said he was neutral in the matter. I have always trusted that man to the right thing, it is surprising he would act in his own interest..stunning turn of events, unseen in the past.

Probably on Wednesday, the Company will post the award as the official list, and our positions on the list will change in catcrew. I will move down 700 or so numbers, and probably lose my 76 award on the ensuing system bid. I wonder how many West Captains will come East? I am sure not looking forward to going on reserve.

I know you are probably all surprised I am throwing in the towel, but the law being quoted here on this forum by the West Class is overwhelming. I really thought we had them having won in the Ninth, and again with Silver. But they are all against us. Resistance is futile, they have us, it’s over.

The problem I see here, is AMR is trying to redefine what a higher court stated in their opinion of ripeness. AMR has a slightly biased look at things, as they could careless on seniority as long as it doesn't interfere with their millions waiting to be dumped into their pockets.

Their filing sounds nice and all, but I believe Judge Silver is going to have to take the esteemed opinions of these lawyers (with no real vested interest, ya right) and compare them to what the higher court stated and laid down as to the requirements to meet the ripeness test.

What was it that the 9th stated about ripeness?

I'm happy you feel smarter than the AMR attorneys. Really, I'm happy for you. Lol

When judge Silver lays that injunction on usapa that is it.

The Nicolau is used in the M/B arbitration and we move forward.

When APA takes over usapa is dead and buried. Usapa has no standing in court to appeal anything. You can collect all the donations you want but individual east pilots have no standing to appeal. The injunction will be against usapa, the company and successors meaning the new American and APA. Our new union will be required to use the Nicolau list.

You will have no standing to appeal anything.

It is not a DFR so you have no cause to file a federal suit.

Spend your money but you have nowhere to go.

Bingo, they just want their money and want AMR off the hook, funny no one has posted USAIRWAYS proposed solution ie filings and how it differs from AMR!, A bit odd , ya think,? Giving judge Silver options?
 
I'm just not a thief like you, we agreed to binding arbitration.

End of story.


We agreed to a process that "featured" binding arbitration, had the "process" been completed, it wasn't.

We have agreed to a "new" process that may include binding arbitration, it may include the NIC, it may not, probably not.

It will be some combination of DOH, slotting, fences and C&R's.
