Let me get this straight. In your world our case is not ripe right up to the point that it is to late.

Never getting a chance to obtain justice.

Does that sound like a system that you want to live with? A system where you never have your day in court?

I believe Bybee of the ninth said this very thing during the hearing. He know what scum bags east pilots were. He stated this strategy 3 years ago. You all had better hope that is not the legal system we have. Because one day that will turn on you. Majority rules remember that mantra?

Besides why so afraid of have the court decide who is right?

What you really should be afraid of is if the company, urged by the money guys decides to finally follow thought with their legal agreement and just declares the Nicolau the list. No hearing, no trial, no appeal.

Oh yes...the company should hurry out and do this. And if you win, make them retrain 1//3 of the pilots on the seniority list to correct for the NIC. That would be REALLY smart. I did some quick math and that would run them in the neighborhood of $70 to $100 million dollars.

Honestly Captain Gay, you have been told by the highest court any of this went to that you need a JCBA. Just because that ambulance chaser Harper thinks differently, it isn't ripe. USAPA needs to sue Leonidas for harassment.
The company cannot tell the union what list it will use. Your lack of knowledge of the RLA is appalling.
Face the fact, you are going to lose. As much as Silver wants to help you, and she does, she is too smart to bend the law. This latest Leonidas effort is another loser.

"not guilty" and has, in it's time, imprisoned and even executed innocent victim's of his whimsical insanities. Nothing invented and operated by human beings will ever be perfect.

I'd hate to really burst your bubble and dare suggest that even the grand "perfection" of arbitration's not handled by divine power alone. :)

In the LEGAL world it's not ripe until the knife is finally thrust. And you had your chance to "negotiate" back when we had ALPA. Your fantasy is about to end on the 14th. I am sickened, like all of us here at the Airline, at the total INCOMPETANCE and intransigence of the AwFOL group of which even your lawyer has characterized as not represented by the VOTE of the majority of those 1017 EVIL WEST PILOTS. "Barely more than half of the West Pilots with positions on the Nicolau Award list voted to ratify the MOU. Even if the MOU were an overt vote on whether to abandon the Nicolau Award (which it was not), a bare majority of West Pilots cannot consent to abandonment of the Nicolau Award." Why, the arrogance of those BA$TARDS & BITCHE$, TRAITORS....TRAITORS!!! (Marty doesn't discriminate)! Every employee at this airline will be dancing on the grave of your anti-employee antics and I AM PERSONALLY LOOKING FORWARD TO GLOATING ON THE 14TH WHEN IT HAPPENS!

Spend more time with the dictionary and less time cutting and pasting from law books. You'll be a better person for it....

Lemme' see if I've got this right: 98% of west voters approved the MOU, but a mere "Barely more than half of the West Pilots.." voted, which still constitutes a majority, but then; "Only about 2/3 of the members..", so...said majority's really only an insignificant "subgroup of West Pilots"...? ;) Sheesh!...I've always heard it was impossible to speak outta' more than two sides of a person's mouth at the same time. It turns out that isn't true at all. :)

Your post reminded me that I meant to check Dr. Marty's math. Now, I'm no mathematician, so someone tell me what I'm missing. He says that "Barely more than half of the West Pilots with positions on the Nicolau Award list participated in the MOU ratification vote." Well the current west seniority list on wings lists Odell as number 1639 and we know that everyone about him on the list was covered by the Nic. USAPA's voting totals showed that 1041 west pilots voted. That's about 64%. Does that qualify as "barely"? 2/3 voted YES, loud and clear and I would imagine that most of the rest of the west guys were ineligible. Who's fault is that?

BTW, the west turnout was better than the 2012 presidential election!

My point of view on the reason USAPA exists and what has transpired since the Nicolau Award was rendered in 2007 has not changed, if that is your implication.

Indeed. It'd be amusing, but not even worth the effort to post his earlier supportive posts, from not long after the nic came out. Po' widdle baby didn't get to shorten his commute to PHX, and in doing so; "nobly" kick some westie outta' the top spot. How truly tragic for the whole of western civilization...and what fine and noble basis upon which to change anyone's "moral" positions. ;)

Date of Hire is Unity and Unity is Date of Hire.

And yes we do deserve to go to the top of the list. We paid for it with our pensions, work rules, vacation, sick leave, quality of life.

The Parker/Lakefield dream would never have been a possible without the sacrifices of the USAirways employees.

We bring lots of flying and lots of retirements to the merger. Who should benefit from the USAirways atrrition? Certainly the USAirways pilots, including the furloughees.
