Dear Mr. Minerva:

This is in response to your letter dated September 17, 2007 in which you provide notice of the company's concern regarding posters urging job actions by US Airways pilots. ALPA investigated this matter and was unable to find evidence of such posters.

ALPA has now learned that the posters were labeled with the USAPA logo and the company has forwarded copies that confirm our understanding. We further understand that the company threatened USAPA with legal action and financial penalities if it did not quickly take action to inform pilots that it did not support any such job action. USAPA immediately issued a disclaimer on its web site acknowledging that such action "would be a violation of the Railway Labor Act and contrary to the interests of the pilot group."

While ALPA does not agree that it is under any legal obligation to do so, because of the risk to individual pilots who might engage in such action and at the company's request, attached please find a copy of the notice that ALPA will be issuing through appropriate communications vehicles today.

Why today's ALPA EC news is not so bad

I was initially disappointed in today’s EC actions, but the more I think about it the more I am encouraged. Why? Today’s action should remove any doubt from the USAPA fence sitters that ALPA will not do anything regarding the Nicolau Award and the EC has washed its hands of the matter. And, I believe the EC took this action because of the USAPA threat with the new union having over 2,400 Authorization Cards.

O.K. So the question is now what? In my opinion, the East MEC will authorize US Airways East NC members to re-enter JNC talks, but nothing says a TA has to be negotiated and nothing says the East pilots have to ratify a contract. And, the lawsuit will proceed and could be dragged out 3-5 years.

Furthermore, today’s action will likely strengthen USAPA, it will undoubtedly accelerate “kicking†ALPA off of the East and West property, and if there was ever a chance for a negotiated settlement it is now because the choice for the AWA pilots is simple: Cut a deal or have union “impositionâ€.

The US Airways pilots still control whether or not the Nicolau Award is implemented and that is with their JNC vote. Therefore, the Nicolau Award still cannot be implemented, the US Airways pilots still hold the tools to block its implementation, and the US Airways pilots are holding all airline pilot new contract talks hostage.


Also noteworthy, I have cut and pasted some of tonight's email messages from some US Airways pilots.

Today, your ALPA Executive council voted to:

·ALPA will present the Nicolau list to the company.

·ALPA National will pick up all costs and responsibility for defending the list.

·Denied our request for MCF funding for Pay Parity campaign.

·Reinstated AWA MEC MCF funding.

·TA dispute denied

Today’s EC vote let us know loud and clear where we stand with ALPA. Is there anything more they can do to us? Did they miss anything? Have you had enough of ALPA?

Please send a card in ASAP and let get this decertification party started.

ALPA national has written off this pilot group.

We will have an (USAPA) election soon, its time for every USAirways pilot to take an active role in how this new union will represent you, the USAirways pilot.

ALPA just told us today, that we are not important to them any longer, they know exactly what they are doing, they think they can live without our dues money, and they will teach us a lesson in the meantime.

Not on my watch, if I have anything to do with it.

Get those cards in ASAP, let’s take our balls and go home.

You are correct. If this ####-slap by ALPA National doesn’t galvanize this pilot group, I don’t know what will. As you stated, the waiting for ALPA to do something is over. Now we know. The next move is ours. I will never give in to this injustice.

Bruce, get a coherent title and some one may care what you have to say.
He does have a coherent title. Problem is, the poster can't accurately type what he's copying.
 
Since I can already see where this one is going, I will post here what I just posed on the West ALPA board

1. If an article/letter/item is being discussed already in the East thread, please do NOT start the same argument/discussion here. If that trend continues, we will consider having only one ALPA thread a week and that will be a mess.

2. Do NOT quote entire posts in your responses, ESPECIALLY when your response is immediately following or in proximity to the post you are commenting on. It wastes bandwidth and affects the readability of the boards.

3. NO PERSONAL ATTACKS OR INSULTS. Our patience is wearing thin, and there will be no more warnings.

USA320Pilot comments: Obviously, you do not know me, which you do not. I'm actually quit "juiced" now and ready to fight the Nicolau Award even harder. The East piltos still hold the trump card and that is to never agree to a joint contract.

Moreover, today's EC action will cause the "fence sitters" to support USAPA because ALPA washed their hands of the situation.

It will be fun collecting USAPA dues from people like you and Aquagreen!

The EC will represent the pilots in the Joint Negotiations if the East MEC does not show. Prater has already said so. Don't be surprised if they steal from the East just like they stole the Pension.

The threat of loosing $11 Million will continue to inspire the very best of ALPA. Fabricating the USAPA sickout was only the beginning.
