Dear Mr. Minerva:
This is in response to your letter dated September 17, 2007 in which you provide notice of the company's concern regarding posters urging job actions by US Airways pilots. ALPA investigated this matter and was unable to find evidence of such posters.
ALPA has now learned that the posters were labeled with the USAPA logo and the company has forwarded copies that confirm our understanding. We further understand that the company threatened USAPA with legal action and financial penalities if it did not quickly take action to inform pilots that it did not support any such job action. USAPA immediately issued a disclaimer on its web site acknowledging that such action "would be a violation of the Railway Labor Act and contrary to the interests of the pilot group."
While ALPA does not agree that it is under any legal obligation to do so, because of the risk to individual pilots who might engage in such action and at the company's request, attached please find a copy of the notice that ALPA will be issuing through appropriate communications vehicles today.
