Hmmmm. Blathering about a 8+ year old video and your assessment of the actor's personality multiple times. Not desperate at all boys.
I forcast a great deal of East wailing & gnashing of teeth this next Spring. Maybe we can produce a video that will help to soothe you.

Hey BoyCactus, how's that video coming?...........come on the bucket of Bojangles is on me, will have a good laugh over all this.

Sorry, the Nic is still the only accepted system seniority list applicable to all LCC pilots. Oh, and it is still very much in the contract.

By contract I mean the MOU.  Take another look, the Nic is in there!

We took another look, still don't see it, maybe you can help us out!

You are gonna love the "fuzzy math" in January, when the expert witnesses shred the east career earnings expectations at the SLI.

But you should not worry.  Nic gave you more than you deserved in the LCC merger, and you will ride the West coattails in the AAL SLI.

Too funny!

The MIGHTY U-Turn Says: WE TOLD YOU SO!
"U-Turn: Taking Responsibility According to our reports, on Day One of Wye River, Jeff Freund warned the West MEC that if USAPA won, the West risked losing everything. ALPA's lawyers knew the list was negotiable,"
"Our former MEC and our union leadership played a very high stakes game of poker by not dealing at Wye River. Freund was right, we were risking everything..and right now, it looks like we lost. They need to take responsibility for that."
"The U-Turn Wye River: ALPA's Last Stand Back to Wye River. Did West Merger Attorney and West MEC advisor Jeff Freund really walk out of talks because the MEC refused to give on the NIC or did West MC Chairman Ken Stravers chase him out?"
Dave Blomgren, for the U-Turn
Wye Davey boy did you not listen to Mr. Blomgren?.................is he a liar? Still waiting for that answer!

Thank you from all the east pilots for not listening to Mr. Blomgren.

I really don't give a rip if it's mentioned in the PA, ASAP, AQP or STHU.

I am more than pleased that 2 of the 3 parties recognize it as the beginning point for the LUS pilot group.  I am more than pleased that the Nicolau Seniority list is the ONLY legal combined list delivered to and accepted by the company.  I am more than pleased that the BOA knows intimately all of the steps that AAA & USAPA have done to secure a DFR for the exclusion of a seniority list that is the product of a process that ALL parties agreed to.  I am more than pleased to know that USAPA's DFR is out in the open for EVERYONE to see.  I am more than pleased to know that USAPA can NO LONGER spend its remaining funds FREELY.

I'll be more than pleased if the Nicolau List is the starting point as directed by the Board of Arbitrators.  Here's today's question:

 • If the Nicolau Seniority List IS the starting point as directed by the BOA, will you NOW HONOR and ABIDE by the product of a process that you have agreed to?
Never mind.  We already know that you kids will FIGHT this to the grave.  The GOOD NEWS, you ask?  You won't be able to use the money of the America West pilots!  Maybe you can start up some cute little legal group and give it a COOL name!  Sorry, the Army of Leonidas is already taken, and I believe our ties are copy written.

Good luck...(NOT).

Wonder if he's still pleased?...

Good morning children.  Today's lesson is considered an "idiom".  The idiom is "FOOL'S ERRAND"

FOOL'S ERRAND

A task which is widely known to be unwise, yet is carried out against a person's better judgement.

"Steven specifically asked Katzenbach about the formation of a new bargaining agent as an avenue of advance to get around this award.  The legal expert advised him against giving the other side a large body of evidence that the sole reason for the new union is to abrogate an arbitration.  Those reviewing this piece of evidence said doing so would be considered a fool's errand."

Gotta luv this one!

US Court of Appeals for the Ninth Circuit                                                                       26 June 2015

“…USAPA has served as the stalking horse for the East Pilots’ exclusive interests and left the West Pilots bereft of representation.  USAPA’s manifest disregard for the interests of the West Pilots and its discriminatory conduct towards them constitutes a clear breach of duty.  Accordingly, we reverse the district court’s conclusion that USAPA did not breach its duty of fair representation, and remand with instructions to enjoin USAPA from participating in the McCaskill-Bond proceedings except to the extent that USAPA will advocate the Nicolau Award..

Arbitration
The submission of a dispute to an unbiased third person designated by the parties to the controversy, who agree in advance to comply with the award—a decision to be issued after a hearing at which both parties have an opportunity to be heard.

Arbitration is a well-established and widely used means to end disputes. It is one of several kinds of Alternative Dispute Resolution, which provide parties to a controversy with a choice other than litigation. Unlike litigation, arbitration takes place out of court: the two sides select an impartial third party, known as an arbitrator; agree in advance to comply with the arbitrator's award; and then participate in a hearing at which both sides can present evidence and testimony. The arbitrator's decision is usually final, and courts rarely reexamine it….

Today's word(s) are:  STALKING HORSE

stalk·ing horse

noun
noun: stalking horse; plural noun: stalking horses

 • a screen traditionally made in the shape of a horse behind which a hunter can stay concealed when stalking prey.

 • a false pretext concealing someone's real intentions.

 • a political candidate who runs only in order to provoke the election and thus allow a stronger candidate to come forward.

[/*]

Origin:  early 16th century: from the former practice of using a horse trained to allow a fowler to hide behind it, or under its coverings, until within easy range of prey.
Here's that term used in a sentence:
“…USAPA has served as the stalking horse for the East Pilots’ exclusive interests and left the West Pilots bereft of representation."
Have a wonderful evening.  We'll see  you for tomorrow's lesson.  BIG SMILES!! :D

YES BIG SMILES!

Hey Kids!  Just finished dinner and had time for one last new word!

ABROGATE

ab·ro·gate
ˈabrəˌɡāt/
verb
formal

verb: abrogate; 3rd person present: abrogates; past tense: abrogated; past participle: abrogated; gerund or present participle: abrogating
repeal or do away with (a law, right, or formal agreement).
"a proposal to abrogate temporarily the right to strike"

synonyms:

repeal, revoke, rescind, repudiate, overturn, annul; More

disallow, cancel, invalidate, nullify, void, negate, dissolve, countermand, declare null and void, discontinue;
reverse, retract, remove, withdraw, abolish, put an end to, do away with, get rid of, end, stop, quash, scrap;
disaffirm

"the time has come to formally abrogate this outdated agreement"

antonyms:

institute, introduce

Here it is used in a sentence:

From “A Conversation with an Attorney” - between Bradford &  Chris Katzenbach of Katzenbach and Khitikan, a labor law firm (Chris Katzenbach point):  “Don't give the other side a large body of evidence that the sole reason for the new union is to abrogate an arbitration, the Nicolau award, that in the opinions of most judges, should be allowed to stand due to no gross negligence or fraud.”

This in response to Bradford saying the following:  “I next specifically asked him about the formation of a new bargaining agent as an avenue of advance to get around this award…”

Isn't this fun kids?  We are REALLY learning some very valuable LIFE LESSONS each day.  See you kids tomorrow!  Have a great night!  BIG SMILES!!  :D :D

Yes this has been very fun..........but the end is near.

“Of course, in negotiating for a particular seniority regime, USAPA must not breach its duty of fair representation. Accordingly, if USAPA wishes to abandon the Nicolau Award and accept the consequences of this course of action, it is free to do so.  By discarding the result of a valid arbitration and negotiating for a different seniority regime, USAPA is running the risk that it will be sued by the disadvantaged pilots when the new collective bargaining agreement is finalized. An impartial arbitrator’s decision regarding an appropriate method of seniority integration is powerful evidence of a fair result. Discarding the Nicolau Award places USAPA on dangerous ground.

Judge Roslyn O. Silver, Chief United States District Judge

No. CV-10-01570-PHX-ROS ORDER; October 11, 2012
