On June 14, 2007, this group met with another law firm to inquire whether
“formation of a new bargaining agent” could prevent implementation of the Nicolau
Award. A report of this meeting explained how they could use a new union (USAPA) to
evade honoring the Nicolau arbitration. 45
46. In August 2007, USAPA’s counsel provided an opinion letter that USAPA
published to the East Pilots, stating
You have asked us to provide our legal opinion concerning whether
Arbitrator Nicolau’s seniority integration arbitration award could be
overturned or otherwise modified via litigation or subsequent
negotiation.
 
Federal case law supports the conclusion that any effort to
overturn the Nicolau award via litigation would be fruitless. By contrast,
we believe that a successor union would be free to negotiate with US
Airways concerning the terms of any seniority integration

ALPA got the boot for many variious of reasons, and the Nicolau abortion was definitely one of them.
 
The courts have been all over this, at infinitum and ad nauseam, because you a**holes wanted to send Marty's children and grandchildren through their doctorates.  And we all know what the courts have consistently RULED.  And those that have withstood appeal are obvious to everyone....except, I guess, you.

If you'd get off your lazy butt and read the court documents, then you would have a more informed opinion. The courts have ruled and your victory was pyrrhic which is tantamount to a defeat.

Your thinking is dictup. Are you lost because the East Committe is slow with updates and you have no misinformation so you just make up stuff? Pyrrhic is exactly that along with binding. This process is going to remove the * symbol because the APA knows they are dealing with a group that will always find an asterisk to get out of an agreement.

What he has enjoyed is clocking massive digits on his W2 driving his 330.
Take a good look when you coast by A Con in PHL in your burned out 319 that you brought to the merger. It has been 10 yrs and you are never getting in it. Sure looks beautiful in AA colors.
You and Brian Williams can make up some more tall tales. Your Move2 CLT was a real good one.
The 767 flying was another whopper you integrity challenged opportunists dreamed up.

My integrity is doing just fine, thank you very much. Good ol Steve Bradford goes hunting for a slick attorney to tell him binding was not binding. Now hand me some green so I will to tell you whatever you want to hear. Leonidas was formed to defend against those who don't have any integrity whatsoever.

Exactly!! Binding is binding...and any Union inherits all obligations from any preceding FBA's. That's STATUS QUO as defined by the RLA. You had years and endless resources to change the agreement. You failed.

Bradford is the Founder. He probably will be enshrined in the Carolina's Air Museum. Him and the white van. Cleary, well we all know how he owned you.
Too bad your premature tendencies are keeping you from voting. 600 or so is the whisper number. Premature adjudication, premature dues termination, and you probably prematurely, well.....
We have all seen the MIT salary numbers. If you wish Brian, I will serve them up again.

Per McCaskill Bond agreement you have to be represented buy your official CBA agent.  Per McCaskill Bond law you do not have to go to arbitration. 
 
The law was written due to the past actions of American Airline Unions handling of seniority in merger and acquisitions.

This has always been a contractual issue. No one escapes the terms of a contract, and no one invents terms of a contract after the fact. No one. The 2005 TA was proved to be in full effect (and compliance) on numerous occasions for the full extent of its past life... and the 2005 TA has been superseded twice.

It's just facts. No implicit assumptions or emotionalism. Reality, try it sometime.
