If a Merger is announced between US Air and AA the very first thing the West is going to do is notify all parties of the multitude of impending lawsuits if they alter the Nic. Who's going to risk a multi billion dollar transaction by aiding and abetting the behavior of USAPA that was ALREADY PROVEN to be illegal by a Jury? Good Luck, Keep the Dream Alive!!
Don't assume AA will be the only other player.
There are no impending lawsuits that affect this company's ability to do M & A. None. Parker could drop litigation in NY, NC, and/or AZ tomorrow.
No one will attempt to alter the "Nic." It will stand forever as a monument to the failed merger policy of a once great pilot union. But it will never be used.
You are also right about no one risking a multi billion dollar transaction. Squeeky wheel will be greased. Where is the fluff in the US Airways system? CLT? DCA? PHL? Don't think so.
