Update: Felony charge against Perry is thrown out by appeals court

The coercion charge is dropped. The "abuse of official capacity" charge is still standing for now.
 
A Texas state appeals court on Friday dismissed one of two felony counts in an abuse-of-power case against former Governor Rick Perry stemming from a 2013 veto by the now-presidential candidate.

The Texas Third Court of Appeals in Austin threw out a count of coercion of a public official, saying it violated Perry’s right to free speech. However, the court let stand an abuse of official capacity charge.

In a 97-page opinion, the court said the statute on which the “coercion of a public servant” violates the First Amendment and cannot be enforced.

"One down and one to go," Tony Buzbee, Perry's lead attorney, told Reuters after Friday's ruling. "We believe the only remaining count is a misdemeanor and raises the question of whether the exercise of a veto can ever be illegal in the absence of bribery.
 
It was a brilliant strategy by his attorney to challenge this on the basis if the 1st amendment. I look forward to reading the entire opinion.

The Texas Court of Criminal Appeals said in a 6-2 ruling, that they were throwing out the remaining criminal charge against Rick Perry.
The charge, related to Perry’s 2013 threat to veto money for Travis County prosecutors in an attempt to force DA Rosemary Lehmberg from office, had violated the Texas Constitution’s “separation of powers provision”

“I’ve always known the actions I took were not only lawful and legal, they were right,” said Perry


It improperly violated the governor’s veto authority.
The court said veto power can’t be restricted by the courts and the prosecution of a veto “violates separations of powers.”

To be objective, yes I will, if it doesn't turn into a spectacle against the rule of law.
