Oops we goofed

Got this note tonight from a friend. I had heard something from someone else at work tonight about this, but wasnt able to get the entire story. Anyone have any insight as to why/who is affected? Looks like a major screwup. 15 months later?....dont think so. If anyone knows of anyone who this has affected, please PM me so I can connect some of those who have an interest in pursuing this.

dont know if you have heard of the shake up yet but in short, those of us who returned of furlough last year feb or so....came back at 17.00/hr and now they are telling us 15 months later that they over paid us and they are taking the over paid moneys(thousands) out of our checks for next year or so.
I am furious. I specifically asked HR and everyone else ie: managers, before I accepted to come back what is rate of pay,seniority , vacation, etc. They all told me 17.00/hr
That is what I agreed to coming back. I feel that Usairways and I entered into a contract at that rate when they offered and I accepted and that is what they have been paying for 15months. Now they say it was a mistake and I and others have to pay for it.
that is wrong.
what can the union do for us?
Or do we need to get an attorney?
How do find out who else this has happened to?

It's true but the affected employees should NOT have to repay for the company's mistake. I've sent you a PM on the matter as well.

Have you checked with your union .. if you're in a represented group? That would be my first stop. If you are, I would grieve this especially 15 months down the road. Good Luck!
 
Have it in writing that's what they said? If not, don't waste more money on an attorney as you'll lose. If you are in a represented group, you'll lose the grievance as well as the pay rate is probably covered in the CBA which will take legal precedence over anything you were told verbally.

If you have direct deposit you may want to move cash to another account as the direct deposit form you signed gives the company a legal right to dip in a draft the account back out if you were overpaid error.

Not trying to be a downer, but the reality of the situation is you are most likely screwed.
 
The company has the right to take back any money overpaid, but there are limits to how much they can take out of each check at a time.

There is also the issue of taxes that you paid on the overpayment that you will have to work out.

I would contact the union and have them sort out the numbers of who was overpaid and the details of if and how the problem will be solved.

As Sam Goldwyn (of MGM, Metro-Goldwyn-Mayer) said many years ago, "A verbal contract isn't worth the paper it's written on." Someone else posted it above--if you are in a represented group, the only thing that matters is the CBA and what it says.

Do you have an update as to how many returning furloughees systemwide were affected by this error? What was the response from the CWA? IF the overpayment must be paid back, why can't it be just from early May onward when the error was discovered; instead of retroactively to when the employees were recalled?
