I've thought about your question also. The decision should be based on the facts presented from both sides. If the arbiter takes into consideration the financial condition of the company, then in my opinion the work is lost. In all fairness though, the arguement has been that the company didn't have the facilites or tooling to complete the checks. If this is proven to be false, then the union should prevail. Hey, but stranger things have happened !!!
