Reread my post. USAPA didn't use the Nicolau in their SLI proffer but the APA did. AND the Nicolau was never null and void. If it was, the company would never be in court right now trying to get a ruling on not using it. Where do you get this from?
The APA won't proffer a NIC list or they risk "TWA" all over again! They might as well proffer an AMERICAN TRANSAIR AWA LIST! Remember their risk in arbitration under MB is as great as anyone elses!

Well good hold that thought WESTIE, Judge Silver said so remember, now do you think the APA will hold any water against 2 federal judges, hey go TITANIUM! Wakes order was VACATED! USAPA free to negotiate! Is APA going to defend an award that isn't theirs, how riiculious MARTY has gotten!

Why won't they proffer a list based on Nicolau? What's stopping them? They'll make their argument to the THREE arbitrators and they'll decide. What does "TWA" have to do with anything? The APA is free to submit whatever list they want as are we with the only difference being we have no legal recourse whereas the west pilots do.
And remember this line: "A decision by the arbitration panel is final and binding and is not subject to membership ratification."

Who stated USAPA wasn't free to negotiate? I said they're going to submit a list based on DOH, did I not? Dean stated that as well in CLT. What are you not getting here?

The EAST has plenty of recourse, and TWA, and ALPA the little seniority DFR, you think APA won't own any liability in a NIC list that was vacated by the 9th and SILVER, DANGEROUS GROUND! For APA!

Really?, well maybe you should have thought of that when you limit your income potential to DUI DOUG, The litigation that will be propagated in a usairways run @ie merger is unfathomable, AA and HORTON have the RISK, REWARD, formula, besides when the "REAL MONEY" shows up, the UNSECURED money and bondholders will be equally as happy! Not so much DUI DOUG!

Why would the APA proffer the Nicolau when it will cause them the exact same problems that the east pilots have with it. Just as it did with the east, it would place a s***load of much younger pilots in positions senior to them. They will just as effectively roadblock an APA pilot's advancement as they would have an east pilot's. They're not going to shoot themselves in the foot just because you say they can.

There's little doubt in my mind that the roadblocks will occur anyway as I think arbitration will very likely result in a ratio list. But the APA doesn't want to block themselves out of upgrades, so ignoring the Nic will make it somewhat better.
 
With your scenario, if I were an American Airlines pilot and the APA put a list in front of the arbitrators based on Nicolau, I would file a DFR against the APA.

For what? You're being represented by USAPA for the SLI. And who do you think is going to fund the DFR? Us?

AS usual an excellent point, besides I would luv to see the "FINANCIAL DATA" and some crew news video defending APA to hold up the NIC and defend it as a starting point, new company , remember?!
