The difference between the United and US Airways restructurings is that the court knows in the case of the Chicago-based carrier that the airline has been unable to articulate a plan of reorganization (POR) and the ATSB rejected their proposal three times.

However, that was not the case with US Airways who had a POR, ATSB approval, and now a new business plan. It is widely accepted in most circles that any union that does not have an agreement in place if the company files for bankrutpcy will have a S.1113 motion filed and then the court could order deeper cuts.

According to ALPA MEC Chairman Bill Pollock, the US Airways and the ALPA NC have been exchanging proposals today and are still negotiating as of 4:30 p.m. EDT. Communications Committee Chairman Jack Stephen reported earlier today, "As information and events develop, they will be announced on the code-a-phone and the website, so please continue to monitor these communications."

It's my understanding the differences are being narrowed.

August 21, 2004

This is Jack Stephan with a US Airways MEC update for Saturday, August 21st, with one new item.

Transformation Plan negotiations continue today between your Negotiating Committee and management in Arlington, VA. The Committee and management will discuss ALPA’s counterproposal to the Company’s proposal of August 17th.

As information and events develop, they will be announced on the code-a-phone and the website, so please continue to monitor these communications.

Please remember we have 1,879 pilots on furlough.

Yeah, but remember he is so far on the "inside" that he is like a tape worm in a dogs stomach... so he even knows when they are gonna have "wind in the pipes" before they do.

I stand by my original statement. If a TA is brought forth with ANY change to the current DC plan it will not make it to the rank and file for a vote. On that you can count. And, F/O 320, that is inside information you or hawk have no way of knowing. If the DC plan is not intact there will be no rank and file vote.

Considering Hawk's track history record, can you say Eastern, I would think this swings heavily in Mwereplanes favor. You know what they say about recruiting from the losing team.

I see once again the fabricator of the facts spews his venom, why don't you back up your statements, oh wait, you never do.

Still waiting on the specific clause in the IAM Mechanic and Related Contract that is "painful".

The only opinions that matter in a TA coming to you and I for a vote are the opinions of the MEC members who represent the majority of the pilots left on the list. They will determine whether the TA sees a rank and file vote. Get it? You are tap dancing around the issue. Let me spell it out so you understand. Any TA that does not make it to the pilots for a vote is worthless. Doesn't matter what's in it.

The company is gambling on weakness from the MEC members who represent the majority. They will lose that bet. You thought the PHL recall was going to succeed too. It didn't. You forget (or are ignoring) the will of the men you despise for their courage and conviction. This isn't about the NC. Its about what they bring to the MEC to put out to the pilots. And that is controlled by the company. If the company wants a rank and file vote they will leave the DC plan intact. If they don't you and I will not get a chance to vote on it.

The only thing I'm anxious about is whether my putter will continue to have problems with the 3 footers. Not whether I have to order an F/O cap. And certainly not MY retirement. That's still 11 years away in this job if I choose to work to 60. And MY retirement is funded by Keough's from other ventures. Get it? Probably not. Unlike you many of us are ready for a shutdown. Been getting ready for it since Braniff. That is why we can stand and attempt to stop a land grab and try to put something that is reasonable and TRULY needed in a TA to give this company one more last chance. Even though it will likely not save the airline. Not with the leadership and management talent we have. And not with frightened pilots who continue to subsidize the incompetence without demanding performance.

The company and the ALPA Negotiating Committee (NC) are resuming negotiations today and will work into the night.

One important driver in the NC's proposal is the issue of fairness. The NC put into office by the MEC RC4 have changed their negotiating position and they now believe that in order to be fair to every pilot on the list there can be no "sacred cows" left untouched, including the DC Plan.

The most recent proposal is now closer to the America West contract and the NC expects a counter proposal from management today. If no deal is struck between the parties today then many observers believe the union could get a take it or leave it proposal from management as early as tomorrow and if the agreement is not accepted, then as Mike Glanzer said, “Absent the implementation of a new cost structure either through negotiations or imposition through the bankruptcy process, the Company will fail within the immediately foreseeable future."

If true, then the DC Plan that is so dear to Mwereplanes would be totally eliminated and his "chest pounding" would be neutered.

Separately, following the expected TA, to get a vote out to the pilots and to be counted on September 10 by ALPA International, the vote must go out to the membership by Friday, August 27.

Why? A few years ago the MEC controlled by a previous harline regime directed a MEC policy manual change that requires the MEC to be holding the TA for seven days (that is why the deal must be done by last yesterday) before voting on the deal and then sending it to the members for their vote.

As you can see - this will not happen.

Thus, there are two methods to allow the vote to happen by September 10: The MEC could vote to override the seven day rule, which requires a two-thirds vote or the MEC can use a different ALPA permitted voting methodsto shorten the time frame.

Furthemore, Glanzer said, "Based upon the financial analysis and our extensive experience in restructuring, the pilots’ have choices are as follows:

(i) Negotiate a deal with a low cost carrier cost structure and obtain various returns as part of that package.

(ii) Elect not to reach an agreement with the Company and be prepared to accept liquidation or, less likely, the imposition of contractual terms that will be more sever than those proposed (text omitted) with the Company in a gravely (and potentially fatally) weakened positions and forgo the prospect of obtaining any significant returns."
