Didn't you hear? That arbitration wasn't part of a Merger policy! It was part of a Merger guideline?! Who knew it was just feel good ink to to fill up a page of the C&BL? Since its a guideline there are no requirements to accept it. My guess is the East guys won't.

Didn't someone correctly state that these policies/guidelines are for use between the two MEC's during their negotiations. Once you reach the part where you enter into binding arbitration you forfeit your control. The arbiter now has control and can do what ever he likes. Kinda like the recent AS binding arbitration where they had their a$$e$ handed to them...

Even if your tongue-in-cheek analysis is correct, there is still the fact that they agreed to a binding arbitration and whether the arbitration was part of a policy or guideline still doesn't matter since they agreed to the process.
 
I find it interesting that I am not afraid to hide my identity, but others can insult people in this Forum and hide thier [sic] identity. I believe that is being a coward.

The East and West pilot debate keeps going on and on with little progress. Unless the AWA MEC and the West pilots change their position I believe a whole new set of dynamics will enter into the picture in September when USAPA files the NMB Form 1 in about one week or so.

I believe by now most observers clearly understand the resolve of the East pilots and the US Airways MEC. The East pilots believe the Nicolau Award violates ALPA Merger Policy and they are willing to do anything to prevent its implementation.

The West pilots understandably want the Nicolau Award implemented so in a few years they can hold virtually every Captain position.

Piedmont 1984 wrote an excellent post regarding the sentiment of those East Captains at the top of the seniority list and why they support the current East MEC actions, which should be clearly understood by anybody with an interest in this dispute.

Here is the deal. If the AWA MEC does not quickly agree to both EC resolutions and seek a "realistic solution" per the Rice Committee to the seniority integration dispute then I have reason to believe the NMB will take control of the representation process this month. If the NMB orders an election that would create a whole new set of dynamics, which I understand would permit ALPA or USAPA to obtain a 50% + 1 of the vote or a simple majority of those who vote. This would permit the winning union to immediately represent both the East and West pilots, therefore; the East and West pilots would continue to have union representation from the day USAPA is born. The East pilots would the be the “majorityâ€￾ negotiator and the West pilots would be the “minorityâ€￾ negotiator.

If the West pilots prefer to keep ALPA on the property then I believe the AWA MEC must very quickly agree to seek a "realistic solution" to the Nicolau Award problem per the Rice Committee or face union "imposition" before Christmas.

Finally, if the West pilots elect not not seek some sort of a compromise or a realistic solution then so be it because many (maybe most) East pilots no longer care.

Regarding USA320pilot. I do not always agree with his posts, but he is correct regarding the cowardice of the arm chair Monday morning quarterbacking that has been proliferating on this message board. It takes a lot of courage to speak your opinion using your real identity. I do not give my real identity, I do not have the guts like he does.
 
Clue isn't even an employee, much less a pilot on either side. He's right far more than wrong, though, so one would be foolish to disregard what he says.

How do you believe Clue is even qualified to have an opinion on this. I disregard what clue says and I consider him a busy buddy fool.

Jim most of your posts always take the easy noncontroversial approach. I have met your kind before and I am glad you were not around during the birth of this country because we would all be speaking with a British accent.

The fact is this is a legal matter not a spectator sport.

WRONG!!! WRONG!!! Today's problems lie on the backs of the east pilots and their leadership for failing to abide by ALPA merger policy and not honoring our agreements!!!!!!!!!!!!! You talk about others being a coward as if you are anything less than that. Men honor agreements -you guys are a bunch of spineless welchers.

We have the law on our side that says you are doomed for failure. On principle alone, I'm prepared for stagnation and status-quo for as long as it takes - time is on my side.

USAPA = Pyrrhic Victory. If you understand nothing, understand this. USAPA will be hamstrung, in it's efforts to govern, through recalls, representation votes and ultimately DFR suits since it is quite obvious that USAPA does not have the interests of ALL the US pilots at heart.

While I firmly believe that everyone is entitled to their opinion and the right to express it, I personally believe that your opinion, as stated above, is worthy of the both the nearest trash can and an apology.
