“Actually, it is USAPA that is needlessly delaying the resolution of the seniority dispute and jeopardizing the enforceability of the agreement the parties are able to reach. …….The arbitrator’s decision was to be final and binding on both pilot groups and was to be accepted by the Company so long as certain conditions were met.  The Nicolau Award has resulted in four years of litigation including a trial in federal court and jury verdict fining USAPA’s proposal for a non-Nicolau list to constitute an unlawful breach of the union’s duty of fair representation….”

“…The Arbitration Board conducts an evidentiary hearing, with witnesses, evidence and a stenographic transcript. The Board’s Opinion and Award are to be issued simultaneously, within 150 days following the PID, unless both pilot groups and ALPA’s President agree to an extension. The Merger Policy provides, “The Award of the Arbitration Board shall be final and binding on all parties to the arbitration and shall be defended by ALPA.” No ALPA seniority integration arbitration result has ever been set aside by the courts although some dissatisfied pilots have challenged the award before administrative agencies and the courts.”

SANCTIMONIOUS?

Small "surprise" that term would so easily come to "you'se"...umm..."thinking", but if properly applied to your particular case; the reasonably suggested additive of Spinelessly "SANCTIMONIOUS" immediately comes to mind. Now run along back to your pwescious widdle "army", shout a few more chants of "This is Sparta!', wave another "Integrity Matters" T-shirt around...and essentially just tell us all again how twuwy pwecious (and of course "special") your mom mistakenly imagined you to be...? In all my years of flying, you're the very first supposed "pilot" I've ever heard directly defer to "his" mommy's notions of how to think/act and conduct "him"self. 53Cactusboy: "My mother taught me better to not to play with cheats." I rather suspect she also suggested running away to the nearest teacher/authority-figure whenever otherwise called to action by any "bully" on the school yard. As always; thanks for all the laughs.

The courts... yes the courts... Not one binding thing on USAPA, ever. Several binding rulings on the West Class, but never a single binding judgement against USAPA. The only thing Bibee could bring himself to do was to add another contingent ruling to the already contingent contract. Real pillar of jurisprudence their. The courts did a terrible disservice to all LUS pilots. It was all a political hay making experiment. Quite pathetic really, but lucrative as hell.

This is an example of the response you get from someone that cannot come up with a reasonable rebuttal to the argument. This is what not to do children, so please don't allow desperate Dave to lead you to think it is the example of what to do. And puhleeze stop with the legalese cut and paste; it has gotten you nothing and will continue to get you nothing.
At this point even if you get the nic you have lost the war. And even if you get the nic you will still be a junior old fart.

Accepting and instituting are two different processes.

Perfectly put sir, especially per "This is what not to do children"...

I don't understand how getting the nic now means the war was lost?

How could it?

Seems to me there will be a ton of movement to right size the operation post FOS.

Those with a sudden rapid increase in seniority only exasperated by the decade long stagnation will quickly have their rightful place.

Remember, the west didn't just filter into what the east brought, rather we brought airplanes with us, aircraft that didn't exist on the east certificate.

So tired of hearing about time served.

I'd agree, it's fundamental to a finite integration where all variables remained the same.

If the west was a group that simply wanted to integrate with a static east fleet, yes, the nic would be absurd.

However, the west wasn't being absorbed into an east static fleet, it was being absorbed into a much larger fleet.

How could anyone expect to command those new, not ever perceived aircraft to be their own, to just disregard all the crew it took to bring those aircraft as suddenly unworthy, or unfit to command the same airplanes simply because they were younger?

I'm all for protecting what you brought, are you?

Bottom line is this, I see a guy immediately senior to me on the original nic list as now being a captain on the same airplane I fly, at the same percentage, or bidding power that I have as an FO.

He has the same schedule, or days off, or vacation I can hold in the other seat. Only he is sitting in the other seat!

His seat position is different than mine only because of what has transpired over the last decade. Luck.

Luck, plain and simple. The only way that could have happened absent the America west merger was God himself delegating the former US Air as immune to reality, or their reality.

I don't fault that pilot for where they are, I just don't understand why that same pilot doesn't realize that his position is garnered from the detriment of his fellow pilot, in this case, an AWA pilot, through no control of his own, has allowed that pilot all the benefits of where we are.

He is only there because of the merger, us/awa merger.

Nobody can claim we or they saved the other, but it's clear, without that old merger, things would be drastically different, for all parties.

Then I'm comfortable with assigning you all our fullest sympathy, and can only wonder how it ever was that anyone so obviously "intelligent" as yourself could ever even be deemed suitably trusted to drive a few folks around in so much as a taxicab.
