I can't find information on the internet when you get an O.J.I. I looked up the C.W.A. contract and Teamsters with no luck. I'm using the Company Doctor who says I'm probabley O.K. to go back to work but the pain is almost unbearable. She's requested an M.R.I. but its been a week and I'm still waiting for the authorization to come through. I tried to go back 2 weeks ago on limited duty but I was only able to work 3 days before I couldn't do it anymore. 700 you always seem to have an answer, could you tell me where I can find any information, or anyone else know? I'm supposed to go back to the Doctor again today. Will I get paid on an O.J.I? If so will it be from USAirways or the state? Thanks in advance for any help you can give me.

Try looking up workmans comp for your state,lots of info on the web...get well soon.
 
OJI's are handled different from state.

There are no set rules from Corporate.

Check your State Worktoers Compensation Laws. There should be a Commission set up to
give workers guidance. Ideally the Commission has "Ombudsmen" whose job is to help
guide you through the system if you have not yet retained a lawyer. Not knowing what
state your from makes helping you difficult.
 
Know also that FMLA can come into play if you are eligible
and have a qualifying injury.
 
Workmans Comp is a nightmare sorry you got HURT @ work my partner fell in the mens room @ his employer over 3 yrs ago and it has been a BATTLE. First Workmans Comp is so slow to approve anything. STAY on TOP of this , document everything you do, MAKE a LOG. Most states require you to be off work for over 2 weeks before benefits are PAID and then it is just 66 2/3 of your salary. FYI a MRI is so expensive they really drag their feet hoping you will just back off... BUT AGAIN STAY on TOP... call them everyDAY. See what the problem is and what can be done to relieve the PAIN. I have lived and dealt with this for the past three years.

Thx Excop, I agree I'd better document everything, I'm not trying to screw the company but at my age I don't want to be screwed either. (Forgive me for being so crass)
 
AGI is the current insurance carrier tha U uses. Believe me when I say they really suck. In NC there are no provisions in the state comp laws that require the insurance carrier to make sure they pay you on time, there were times my wife would not see a check for three weeks at a time. We had to have our lawyer make phone call after phone call asking AGI to please send money...Good luck and I hope your injury does not result in a lot of time off, it does'nt pay to get hurt....at least not right away.
 
Excop is right. You have to be out 2 weeks to get the 66 2/3 pay and I might add that it has to be concurrent, so if you come back in the middle of the 2 weeks and go back out, you won't be entitled to the pay. In most cases the check will come from Workers Comp. Get their phone and fax number and bug them about the MRI authorization. Also, after all is said and done, if your doctor says you lost a percent of your ability to perform or use of a body part....usually only a couple percent....W/C will compensate you for this too. Even for corrective surgery...ie...knee, elbow, etc. You can download FMLA info on the Justplanenews website. If you've been out for more than 3 days, your on FMLA if they've told you or not. You may find some info in there that may be to your favor. Good luck!
