Yes..And I know about the Railway Act....

He's hoping that the judge will be able to digest all that has gone on in the last few years with the airline and how it is run....

A trustee to run it has been suggested...

The unions have come to the table in good faith to bargain...

The company has either cancelled meetings, or not really looked at the proposals form the unions for cost savings....It is either "Our Way" or "No Way" with constant threats of bankruptcy as a hammer.....

Reports that managers got 4 % raises in April while everybody else has given a billion dollars to the company to help it.....Where did the billion dollars go?...
If they can't manage this company, bring in people who can run it....

RSA a main investor is worth $$$$$$$$$$$$$$ billions with a "B"....it is pretty hard for them to claim being poor.....

I think if the judge is "One Sided" on this...

It is over for the airline....

I hope the Judge asks the airline's "Highly Paid" attorneys "What has the airline done different since the last bankruptcy, to go in the right direction? "...Besides threats of "Using the Bankruptcy.....hmmmmm

i wonder if the unions will try to do what ual's unions did and put forth a motion to try to throw out the mgmt and get a court appointed trustee. i think it is time for all of the unions to send out a confidence/no confidence vote to all employees and see how that turns out! i bet that no confidence would be the big big winner

You guys amaze me.... The judge isnt interested in what we did in the past. Isnt it enough were back in BK and something wasnt done right?????????/ He has an obligation to protect this companys assets......... If it means he has to agree to cut pay he will.....

He should be very interested in what has happened since the last filing. He gave the company everything that they said they needed to make this thing work the last time.

he did no doubt about it, which means you really dont understand whats going on in this industry.Sounds like youd rather just blame this management team. Not sayin that past management was perfect, but it wasnt all of their fault........... Investigate whats going on in the industry, then youll have a well balanced informed opinion....

Here are the real problems:

1. Oil at $53 per barrel.

2. Cost increases for security post September 11.

3. Revenue depression due to tremendous LCC growth and Internet booking.

4. Labor costs that are higher than every carrier except two other companies.

5. Labor resistance to change, which contributed to the judicial reorganization. The formal reorganization caused the loss of over $100 million in revenue due to passengers booking away and approximately $50 million in bankruptcy legal and consultant fees.

Which one of these problems did this management team create?

Well, number three was created by mgmt. They signed em! And let's not forget that they had the highest compensated management too.

Numver five was created by creating a horrendous employee-management relationship.

The rest were not created by the mgmt team, just ignored until they came to a head.

Regardless,
Light Years

1. Failure to hedge pre-BK. Entirely a management issue.

2. Known costs during and after the first BK. Entirely known to management.

3. Known during and after first BK. Never addressed by management.

4. Strawman, because the costs are not higher.

5. The company is only here due to the complete failure of management during and after the first BK.

Wrong. The best management in the world can't get hedges if they don't have the credit rating or available cash. None of the airlines have a favorable credit rating right now except for Jetblue and WN, and few have the cash to pre-pay futures contracts.

Uhmmm, the judge gave 'em everything and that means I don't understand this industry? By the way, you agreed with me, which means you don't understand it either, eh?

Your snippy remarks are juvenile, which is one of many reasons why no one agrees with anything you have to say...even if you were to make a point, which in this case you didn't.

Fliboi better break out the striped shirt and head over to TGI Friday's. I here they're hiring. And, it pays WAY better than F/As make with a 23% paycut. Plus you get to be home every night. Sounds like a deal to me! You have the whole Chapter 11 thing confused. There is a judge because he gets to use HIS JUDGEMENT in making decisions. If it were all black and white there would only be an arbitrator. I get a feeling that even though the company may eventually get everything they want, the judge may embarass them or put time limits on some of the things which they do not want.

Sounds to me like the government needs to quit subsidizing the two weakest carriers (including U) and let them liquidate! Keep the wages up and keep it a respectable field!!!

The BK judge should be concerned how the company is being run, after being given all that they asked for in the first bankruptcywith his blessings....It is now "his reputation" that is on the line and in the media spotlight....

If his honor, feels that he is being used... and being made a fool of by the company....

It might not be pretty....

Especially if he feels that the company is misusing their monies... crying that they can't pay their legitimate bills over increasing their own MANAGEMENT SALARYS.....and defaulting on commitments like pension payments....to fatten thier own bankrolls.....

We will see if the judge does his homework on this case....and has the resolve to made good decisions that affect so many families......
