No airline would have volentarily divested the slots in question. At least not volentarily. The threat was present and they knew this, hence the settled agreement to divest them. Do you really think that AA and US would volentarily divest if there was no suit filed? No way.

Yes they would, they were talking with the DOJ.
 
And when the DOJ wouldn't approve the DL/US slot swap, they didn't file a lawsuit, and they negotiated a settlement and the slot swap was approved with divestitures.
 
So back up your statements with facts, you are only speculating.
