Retired From Usairways .............

PBGC is telling us we can not work for usairways and collect a pension at the same time, well; is the usairways the same company as the old usairways, is pbgc or usairways trying to screw us.
does any one know?
need legal help to fight this nonsense.

By LAW, you cannot collect a pension and remain employed with the same company. I would suggest you contact an Attorney who specializes in Labor laws. The PBGC and or US Airways is not screwing you.

I sent the email to Doug and got a response in less than 24 hours. Good to know you can email your CEO and he gets back to you. He's checking on it for me. As I've said before I completely believe in him and think it will work out for my best interest and that of the company. I'll let ya'll know if I can. If not, then you know I'm happy with the results.
 
This is difficult:

The PBGC does not permit anyone to collect a pension from a corporation and work at the same corporation. The key question is, is US Airways the same corporation? For example, the former Eastern employees who went to work for Shuttle and then to US Airways were able to collect their Eastern pension from the PBGC in addition to collecting their paycheck from US Airways. The difference is that even though they were folded into the US Airways population via the acquisitions and were collecting pension service credits from U, their former employer no longer existed. There is a benefits attorney at the AFA-CWA that might be able to help you.

I believe there is an argument here. The old U is gone. AWA has controlling interest in the new USAirways.

Can anyone tell me is there a time period that you can resign and then return to work and keep your
seniority not payscale, I know you start over but is there an exception for coming back to US?

In my retirement benefit book it just says If I return to work at USAirways my pension check stops and my seniority continues from where it left off---from day one.
 
USAirways is not the same company according to Wallstreet - LCC
I agree...if it is the same I have got some stock to sell. :unsure:

I never new there was a retirement book. Was this issued pre-union?

i email him too but no response yet, my question to him was;

IS THE NEW USAIRWAYS (after the awa merger) THE SAME COMPANY AS THE OLD USAIRWAYS (before the awa merger) and if the answer is yes i want to SELL ALL MY SHARES FROM THE UNITED/USAIR FIASCO.
that will tell me its the same company and i will be happy

Not yet noname. But I did talk to your person. Just waiting for a response from someone. She said they were working on it now. Let me know if you hear anything.
