Quick labor givebacks to USAirways seen unlikely

WASHINGTON, Sept 23 (Reuters) - Labor concessions to bankrupt US Airways (UAIRQ.OQ: Quote, Profile, Research) do not appear likely in the near term to head off threatened court-ordered changes in contracts, Republican senators who met with several pilots' union members said on Thursday.

Common sense - one of the reasons I've been a Specter fan for quite a while.

He does something for labor here at U that improves are ability to negotiate fairly with this managment, promise to reform BK legislation to protect employees while in BK....the republicans will have my vote for ever. He said today when he met with ALPA reps that there is not much the senators can do in this instance. I don't believe that. I believe it is time for legislative reform...that's what they CAN do.

We demand it.

Any legislative reform to the BK code is likely to very long and drawn out. Would have to pass committee, then the full Senate, then get a House bill through committee, then the full House. Then the conference committee must reconcile it. Then the reconciled bill has to get passed onto the White House. This also assumes that no one puts some poison pill amendment to it trying to protect the Orange Blood Mosquito that lives as a parasite for two days every decade on the Kangaroo rat onto the bill before it gets through.

That kind of time frame will do nothing to help US employees, as contracts will be permanently tossed aside before that kind of timeframe. If you don't want to work for what the company is proposing, look into what kind of financial aid is available for worker retraining and get into a field like health care or insurance that will be strong in any economy.

I personally already had training in another field and a license to practice.

There was legislative reform after the BK 2 of CO and the Lorenzo days...it can happen again.

There are bk attorneys who are split in this instance on what Judge Mitchell will do.

WE all make these assumptions, you need to just relax. Fight the fight if necessary. Hopefully for all sakes...won't be necessary.

I guess over 20 years is not "long and drawn out !" This is exactly the situation faced by CO employees over 2 decades ago, and they lost. Management is stupidly testing the waters again to see if the new laws "stuck." My prediction is they DID stick. This may indeed be the end of U, but it is by NO means sure a BK judge will simply negate the legal contracts in place at U...after all, Dave Seagull is proof enough you get what you negociate for...no more, no less, assuming the company stays in business. Dave made d..m sure it stayed in business long enough to pay him, even if he was incompetent in coming out of BK too early. Best. Greeter.

Note that BK reform, even as you state above, came ofter BK2 of CO and the Lorenzo days. It did little good to those affected then, as will anything that help US employees after the contracts get tossed. There is little hope for retroactive help.

All the new laws did what put into place a specific set of standards that must be met to have abrogation, it is no longer automatic. Remember it is about what the creditors want and the unions have little pull. They are a small minority on the unsecured creditors committee. Don't let the rose colored glasses of some fool you. The company has this very well planned out this time.

Thanks for the info....any "standards" this management is faced with will be an inprovement! I know this is not a slam dunk, from either side. I just want some accountability. Best. greeter.

USA320Pilot comments: I agree with your comments. ALPA's legal staff are 100% certain Judge Mitchell will grant the comapny's S.1113(e) motion and he could convert it to a S.1113©, which would make the cuts permanent. The court has approved virtually every company motion in two bankruptcy's, therefore, Mitchell's track record supports the ALPA legal advisor(s) opinions.

By the way, the ALPA advisors are batting 1000% and the RC4 are batting zero.

I have to agree with 628AU, I think that by plan or by default, the situation has developed to create the "perfect storm" of conditions necessary to force concessions voluntarily or involuntarily from the remaining Airways unions...

Were a few things different, it would not be the case. But unless you are in complete denial, you have to see that the Law was not only set up to protect labor from the "Lorenzo Move", it was set up to still protect and favor the creditors when push came to shove.
 
i think that may be it is time for the court to appoint a trustee to run usair as the mgmt has lost faith by the employees. i think specter is right may be it is time to get a court appointed trustee to run usair
 
Pit...your logic is flawed. The fight is only fightable at this point because of the Democrats. Vote however you want. This probably wont be an issue someday if the Republicans have their way. And why are you still there when able to be somewhere else. It was a cushy job for lazy people. You must be keeping your job lady. And dont give me any more BS about something like you're all honorable. Its not what it used to be even at 45 bucks an hour. Which by the way IS HIGHLY INFLATED FOR WHAT I DID, six weeks training? what a great thing it WAS.
So yeah, vote for all the Republicans you want.
