All the judges in this case were elected, so your point remains moot.

Yes, appointments do happen, but it is the exception, not the norm. It occurs only when there's a vacancy created by death, resignation, removal or creation of a new district.

You can continue to claim it was decided on party lines all you wish.

Did you not say that two republicans voted to over turn and the dem dissented?
 
E what do you think? I'm thinking if this case is reversed with a Dem defendant and Dem majority judges this thread never gets started. Trees position might be a little different too.


And of course E being as non-partisan and pure as the driven snow, his position would remain unchanged. From what I have read on the case Delay was guilty and the jury confirmed that. The appellate court invalidated the jury's decision. Something I was under the impression conservatives were against. You know, the not having government over ride the will of the people BS you guys are always talking about. Similar to the Pro 8 situation.

If the rule of law was violated then the verdict should have been overturned.

The appeal decision was not based on any failure of counsel to provide an adequate defense, prosecutorial impropriety, errors made by the trial judge, or any other failing of the judicial system or wrongdoing in the conduct of the original trial.

Two Republican judges decided to overrule a jury of twelve who heard weeks of testimony from over forty witnesses, based on their own view of the evidence.

Or, because they didn't like the result.

Is that really how "conservatives" think the juducial system is supposed to work?

Should we shop around until we find a suitable panel of liberal judges to review the Zimmerman case?

And then, a panel of Republican judges to review the JPM case?

Etc. Etc...

Sure it makes it ok! The man who should be under scrutiny now is Ronnie Earle, whose years-long legal grudge match against DeLay and other Texas Republicans has been thoroughly discredited by the appellate court. Back to you Fly.
