Last time I checked, ruling according to the Constitution is what the Court (by law) is supposed to do. It's the House's job to reflect the will of the people and mold policy, and the Senate's job to represent the states' will.

They really don't matter is the end game.
 
Not voting for either R or D doesn't affect the outcome as they weren't voting that way before.
