USAPA Legal Update - Judge Conrad Signs Final Order: January 11, 2012

Today, January 11, 2011, Judge Conrad signed the joint motion to convert the preliminary injunction, issued September 2011, into a final order of the Court. A copy of the Joint Motion and signed final Judgment are posted in the Legal Library.

As stated in the January 9 update, this means that the injunction will remain in effect until either:

1. USAPA and US Airways reach an agreement on a new collective bargaining agreement, or

2. The National Mediation Board releases the parties from mediation.

Converting the preliminary injunction into a final order avoids the need for expensive discovery, legal proceedings and trial, and allows USAPA to concentrate on representing US Airways pilots.

Pilots are reminded that the injunction remains in effect and prohibits pilots from engaging in any slowdown, strike, work stoppage, sick-out, work-to-rule campaign, or any concerted refusal to perform normal pilot operations in violation of the RLA and prohibits pilots from urging any other pilots to engage in any such activities.

And MELs are down to record lows, wow what a coinky-dnik?
Yeah, the supposed labor action actually spurred the freaks in tempe to loosen the purse strings on maintenance.

Last spring/summer, never a walk-around that I did not see grossly loose fasteners or even missing panels. Now, not so much, though more than one mx stated that the epoxy they are using will play heck with the next inspection. Heh, heh. Morons in tempe. Ought to be interesting.

I am seeing more MELs, we do the write up, they come out and MEL it. Enjoy your company run by idiots for managers while it lasts. PHX has already experienced pilots walking off the aircraft. That will happen until it shutters, just like Eastern.

I hope your kool-aide covers that certainty.

You think the Management in Tempe test and order the epoxy? Nope your fellow idiot co-workers do that.

Coworkers dont buy it, that would be a buyer and an engineer.

Glad to see you want to insult the people that keep this airline flying and safe, that would be maintenance.

Yeah keep up the delusional thought that got you LOA93 in perpetuity, that got you USAPA and their feckless inability to do anything and your constant waiting for the Great Pumpkin. Face it, USAPA got owned on this, a slowdown pure and simple, mathematically proven at the time, and confirmed with the numbers. Quit your whining and fly those planes, or next time, the company won't be so lenient on you slackers.

I work in MX , I know what is going on unlike I club who is just making stuff up. I certianly would consider an engineer and a buyer a co-worker and not management.
