Anyone can sue anyone, the question is does the case have merit legally?
IMO, the Judge will order Discovery and shortly thereafter the parties will strike a deal. There is a similar situation that rose up from Ruch Limbaigh's use of the Pretender's "My City was gone". Seems they asked permission and the Pretenders through their management said yes. Chrissy Hynde later pitched a fit and threatened legal action. However as we all know money talks and BS walks and the song is use to this very day sans lyrics.
